Yes, they may, if it is about operational requirements and not performance AND if they apply the selection criteria objectively
A warning must have an expiry date. I believe it is trite that thereafter it cannot be used as aggravating circumstances, but it can be used to clarify and prove that the employee then new of the rule and that it was established!
