    WHEN MUST PAY BE EQUAL?
    The jobs of a black machine operator and a white safety inspector have been graded at exactly the same level. Their length of service is the same but the safety officer receives a salary that is 50% higher than that of the machine operator. Is this unfair discrimination and, how would the employer, if at all, be able to prove that it is not unfair discrimination?

    EQUAL PAY FOR EQUAL WORK

    In this particular situation it makes no difference whether the one employee is black or white, that is a red herring.

    The equal pay for equal work is specifically to compare and contrast two positions of two people doing exactly the same work. If the positions are different they can warrant different pay.
